MYSPORT is a brand of MYCLUB Sports Marketing Ltd ( Company Nos : 5626699). Registered Head office is Holmfield, 15 Salisbury Avenue, Baildon Shipley, West Yorkshire, BD17 5AA.

Introduction:

These terms and conditions apply to the use of the website at www.mysport.uk.com . By accessing this website and / or placing an order, you agree to be bound by these terms and conditions. Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, please do not use this website.

You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

SECTION A

MY SPORT conditions of use with specific reference to My Sport, My Fashion, My Health, My Travel and My Finance:

1 Goods Purchased

1.1 Any decision made in relation to purchasing goods and/or services as a result of information obtained from a retailer via  the MYSPORT site is your sole responsibility.
You should read the retailer's terms and conditions to ensure that you are prepared to purchase on their terms.
1.2 The inclusion of any retailer on the  MYSPORT website does not mean that either MYCLUB Sports Marketing Ltd or the affiliate sports clubs endorse or recommend the goods or services offered by the retailer. MYCUB  give no warranty of any kind, express or implied.
1.3 All payments or bids made on or via the MYSPORT website are made directly to the retailers and any refunds or queries regarding orders are issues between you and the retailer. We accept no responsibility for non-fulfilment of contracts by the retailers, such as non delivery of product or service/product or services not fit for purpose or broken goods on delivery.
1.4 Customers of the MYSPORT website must read the terms & conditions of the branded retail websites before they make a purchase. These terms & conditions will explain each retailer’s fulfilment of terms conditions.

2 Quality Control & Customer Satisfaction

2.1 Quality control & customer satisfaction are very important to us & therefore we monitor any concerns our customers may have & perform random spot checks on our retailers. If we believe a retailer is breaking the agreed terms & conditions for purchase of their product or service we will remove them from the MYSPORT website.  Please contact us at customerservices@mysport.uk.com if you have any concerns about the service.

MY SPORT conditions of use with specific reference to Dream Bid: 

1. Introduction

1.1 We strongly recommend that, as you read this User Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they contain further terms and conditions which apply to you as a My Sport user.
1.2 These terms and conditions govern the legal relationship between the parties consisting of My Sport, (“My Sport”, “we” or “us”),  providers of “Lots” for auction (Sellers) and registered users of our website (“Users”).
1.3 Defined terms. The following expressions, used in these terms and conditions, have the particular meanings set out below:
“the Conditions” means these terms and conditions, as the same may be modified from time to time by My Sport in accordance with section 1.4 below
"the Website” includes the auction section of the  website, the URL for which is www.mysport.uk.com “Lot” means any goods offered for auction sale through the Website
“Seller” means provider of the Lot in respect of both a Standard Auction, and on occasions when the items are duplicated on other partner sites
“Buyer” means, in respect of a Standard Auction, any User who bids to buy the Lot.“Parties” means the Seller and the successful Buyer
 “Agreement” means the contract incorporating the Conditions, formed between us and any User
“Sale Contract” means, in respect of any Lot, the contract formed between the Parties
“Standard Auction” means an auction in which My Sport offer goods for sale through the Website and invite other Users to submit bids
The use of the pronoun “he” in relation to any person shall be deemed to include the pronouns “she”, “it”, and “they”, and vice versa.
1.4 Formation of the Agreement. All prospective buyers of Lots are required to register as users of the Website prior to making their first bid or trade. By registering as a User, and subsequently by making a bid or trade, you are accepting the then current version of the Conditions and agreeing to be bound by the legal obligations that the Agreement creates. Persons simply browsing the Website may do so without registration.
1.5 My Sport Membership
the website services are available only to individuals who can form legally binding contracts under applicable law. Our services are not available to minors or those users who have been temporarily or indefinitely suspended.
1.6 Reservations. My Sport reserves the right:
1.6.1 to modify the Conditions at any time and without prior notice to Users, by posting the Conditions as modified on the Website. Any amended User Agreement will govern new user registrations from the date that it is posted on the Site. Existing users will be bound by the amended User Agreement after the expiry of 30 days following the date of a Notice. No other amendment to this User Agreement will be effective.
1.6.2 to terminate this Agreement with regard to any User who knowingly and/or repeatedly breaches its terms, and to prohibit access to the Website by such Users;
1.6.3 to suspend access to the Website and the User registration of any User, on expiry of the credit or debit card or other payment method entered by the User on his User Registration;
1.6.4 to remove any Lot from the Website, without notice to Sellers or Buyers and without giving reasons. The list may be updated at any time and includes products or services that advertisement or sale of which would be illegal under UK legislation.
1.6.5 to contact it's registered users from time to time with news of new offers and other matters of potential interest to users.
1.7 Place of contract, governing law and jurisdiction. The Agreement shall be deemed to have been formed in England and Wales (regardless of the nationality of the User or the jurisdiction from which he accesses the Website), and shall be governed by the English law. Users submit to the non-exclusive jurisdiction of the English Courts in relation to all matters arising out of the Agreement.

2. Possession, title and condition of Lots

2.1 My Sport’s warranties. My Sport is responsible for ensuring that we are in a position to sell a Lot before offering that Lot for sale. By offering a Lot for sale, we warrant that the Lot is is in the state described on the Website, and that we have good title and authority to sell it.

3. Formation of Sale Contracts

3.1 Standard Auctions. In relation to Standard Auctions:
3.1.1 if the highest bid exceeds the reserve price, the Seller is obliged to accept the highest bid;
3.1.2 bids are legally binding on Buyers once the auction is complete and may give rise to enforceable obligations under a Sale Contract without any further action on the part of the Buyer or My Sport.
3.2 Notification of contact details. At conclusion of the auction, we will notify the Buyer of the formation of the Sale Contract.
3.3 Completion of Sale Contract. The Parties are responsible for completing the Sale Contract, including making arrangements to effect a speedy exchange of goods and payment. In particular:
3.3.1 it is the responsibility of My Sport to collect payment from the Buyer and to deliver the Lot in a timely manner; and
3.4 it is the responsibility of the Buyer to make payment to My Sport and satisfy itself that the Lot conforms to its description. 

4. Pricing and payments

4.1 Pricing of Lots
4.1.1 Tax. All prices listed for auction items for sale on My Sport must be inclusive of all national and local taxes (including VAT or other sales taxes, if any) payable in respect of the Sale Contract. My Sport is responsible for payment of all such taxes.
4.1.2 Delivery charges. Delivery Charges are included or not in the pricing of Lots according to the indication in the Lot description.

5. Listing Policies and user conduct

5.1 The online facilities are provided for the primary aim of facilitating a deal on My Sport web site. Any use of these or other facilities which encourages or enables a deal to be concluded "off-site" , without My Sport’s written permission is not permitted.
5.2 If My Sport determines that a user has breached these rules, for each instance of a breach of rules we will issue an email to the relevant user.  We also reserve the right to suspend or permanently revoke site access privileges to the user

6. Limitations and exclusions of liability

6.1 Sale Contracts. My Sport, the seller and the buyer  are responsible for completing any Sale Contract.
6.2 Role of My Sport. My Sport is not able to give any warranty as to the quality, serviceability, legality or fitness for purpose of any Lot, or as to the Seller’s title and right to sell, and all such warranties are excluded to the fullest extent permitted by law.
6.3 Use of Website. Users shall indemnify and hold harmless My Sport and its management in respect of any loss or damage to persons or property incurred through use of the Website.

7. Personal data

7.1 Data Protection Act. My Sport is registered as a data controller under the Data Protection Act 1998, and undertakes to ensure that personal data transmitted to us as part of the registration process will be held securely, encrypted to industry standards, and subject to strictly controlled access.
7.2 Disclosure of personal data to third parties. My Sport does not pass on or market personal data to any third party, but may use aggregate statistical data stripped of any personal information to help develop and improve its service offering. My Sport does not and will not sell or otherwise distribute its User list to any third party.
7.3 Disclosure of personal data overseas. By registering as a User and participating in any auction (whether as a Buyer or Seller), each User acknowledges that My Sport may transfer personal data relating to him to any countries or territories outside the European Economic Area and hereby consents to such transfer in connection with the notification of contact details by My Sport under section 3.3 and otherwise in connection with fulfilment of any Sale Contract.

SECTION C

MY SPORT conditions of use with specific reference to MyShop : 

2.Ordering From Us

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we despatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

3.Pricing

3.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

4.Cancellation and Returns Policy

4.1 If you wish to cancel your order:
(a) you can notify us by email to customerservices@mysport.uk.com before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.
4.2 You can return goods you have ordered from us for any reason at any time within 7 days following the day of receipt for a refund or exchange. The costs of returning goods and cost already incurred by us shall be borne by you.
4.3 Upon receipt of the goods we will give you a refund of the amount paid or an exchange credit as required.
4.4 The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances: - in the event that the product has been used, where the packaging has been unsealed to any products that we have made or customised specifically for you
4.5 Prior to returning goods you MUST raise a returns (RMA) request by logging into your account via our website.
4.6 When returning items you are responsible for the safe return and insurance of goods to us. We recommend you at least use a signed delivery service and preferably a professional courier service.
4.7 Please note that  your rights to cancel under distance selling regulations only apply to consumers and not business-to-business transactions.
The provisions of this clause 4.4 do not affect your statutory rights.

5.Licence

5.1 You are permitted to print and download extracts from this Website for your own use on the following basis:
(a) no documents or related graphics on this Website are modified in any way;
(b) no graphics on this Website are used separately from accompanying text; and
(c) any of our copyright and trade mark notices and this permission notice appear in all copies.
5.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.
5.3 Subject to clause 5.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

6.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
6.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

We will have no obligations with respect to such material. 8.3 You shall fully indemnify us for any loss or damage we or any of our group companies may suffer or incur as a result of your breach of clause 8.2.

9.Registration

9.1 To register with www.mysport.uk.com you must be over eighteen years of age.
9.2 Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.
9.3 Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.
9.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

10.Disclaimer

10.1 While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

It is prohibited to access the Website from territories where its contents are illegal or unlawful. 14.Privacy Policy for My Shop

14.1. When placing an order, we require various personal details from you. It is important that you supply all details requested in order that we can validate orders efficiently. You can be assured that we treat your personal details, including email address and telephone numbers in confidence. We do not disclose such details to any third party, except in connection with expediting / processing your order(s). Our policy excludes any disclosure which we are required by law to make, crime prevention, legal action or any issues relating to product safety. We do not hold your full credit card details on our servers. Any partial payment card details such as , the last four digits of the card used, are stored and encrypted in a secure manner.

1.1 By using the MYSPORT website you consent to the collection and use of data by MYCLUB Sports Marketing Ltd, and the sharing of that data with your chosen sports club or charity & the brand partners who are providing the offers across the site.
If we decide under any circumstance to change our privacy policy, we will communicate the new policy under the Privacy Policy for MYSPORT (i.e. this page) in order that you are always aware of what data we collect, how we use it and under what circumstances we disclose it.

2.The Information We Collect

2.1 We like all other major sites track your browse time on the site & analyse where you have clicked from & where you click to by the use of cookies. (See cookies below). If you only browse we do not record personal information.
We collect personal information if you agree to make a purchase with one of our brand partners, or make a bid or decide to join our emailing list. To make a purchase or bid via the MYSPORT website you must register as a user which will require the provision of an email address.
2.2 The information we collect about you will be used by us to inform you of offers, changes to the site and to help enhance the service for your benefit. It is important that you nominate a sports club when you register & a charity if you make a bid, as we will then in turn remunerate your nomination for your purchase or bid.
If you would like us to delete any personal information we store our database please use the link provided customerservices@mysport.uk.com , stating your name & delete data in the title.

3. Use of Personal Data

3.1 Once you register your personal data it may be used by us or other affiliate parties with the aim of provision of enhanced offers & services or to inform you of new products & services that are affiliated to MYSPORT.   You allow MYCLUB Sports Marketing Limited to transfer your data to any future service provider of the MYSPORT website.  You also allow any future operator of products or services derived from the MYSPORT website the rights to use your data for the purposes afforded to MYCLUB Sports Marketing Ltd.

4.Cookies

4.1 Like most major sites we use cookies.  MYSPORT requires the use of cookies primarily to ensure that commissions are paid to your chosen sports club or charity.  For us to track cookies it is fundamental that cookies are enabled on your browser software or we are unable to remunerate your chosen sports club or charity. If you have any concerns regarding privacy, please read our privacy policy.

5.Law & Jurisdiction

5.1 The terms and conditions of the MYSPORT website &  service are governed by and construed in accordance with English law.
